In my state the statue of limitations for prosecution of Class 1 Felony - RAPE is 20 yrs. I didn't say they went for statutory rape, they went for felony rape. The county prosecutor (CoPros) had the woman's testimony, the child's birth certificate, the child's DNA, the DNA test saying he was the father, and a doctor's testimony saying the conception had to be done when the girl was 15. (below the age consent)
The CoPros went after him for all he could; the case was padded with a count of F1-Rape for each time she said they had sex while she was 15, and then offered him a plea deal. Plead guilty to 1 count of F1-Rape, do 8 years or go to trail and risk life in prison with an all of this evidence against him. He took the lesser of two evils.
