Still no Answer by a Mod on why my account was deleted when I had NOT warning or I had no illegal uploads? ALL of my uploads were approved by ML. The same type of videos are still on the site, in fact almost all my videos are still on the site.

If my uploads were all approved, and they were. then why would ML delete my account? You approved each and every photo and video I uploaded? I have asked this question a few times in the past and never given an answer. What can each member do to keep his/her uploads from being a DMCA violation? Since about 70% of the videos on this site are Pro videos, everyone who uploads have to think that uploading this type of video is allowed.

Guidance on this would save both the members and moddies time and effort

Please provide an answer

OP: Your account was deleted because we received way too many DMCA complains about your uploads. They were approved at first because they did not violate our TOU but we obviously can't check if you had the rights to upload those files.
Apparently you didn't because the copyright owners contacted us.

To fbd: OP here...so you are trying to tell the members here that all the Professional Videos and Photos on this site are owned or the member has the rights to upload? We are not that stupid. If you know, and you do know, that every Pro video and photo you approve is in violation of DMCA, and then you approve the videos and Photos YOU are the reason for the DMCA violations as much as any member.

Again I understand that you have to remove DMCA violations, I don't understand deleting accounts for uploads YOU knowingly approve even when they are DMCA violations from. No amount of "But we obviously can't check if you had the rights to upload those files" is going to be believed, every file, I repeat, every file that is not home made and is not uploaded to this site by the owner is in violation of DMCA. You know this, we know this,everyone knows this to be true.

If you were really worried about DMCA violations you would delete EVERY Professional Video and Photo from this site.

I had over 5000 "credits" worth over $250 when my account was deleted. I know of at least 6 people who had "cashed out", they had similar content as mine, so in effect you paid them for the use of someone else's content without a second thought. You also allowed members to buy anonymous contest with credits, credits earned from uploads they did not own, ML knew these uploads were in violation of DMCA but awarded/paid with credits for those upload views.

Following the law is all well and good, but it becomes a lie when you "pretend" you are policing the site by deleting accounts while 70 percent of the remaining video uploads are in violation of DMCA and a even larger percent of the Photos are in violation of DMCA.

Am I pissed? you fucking bet,What am I going to do about it? Well most here would just rant and rave and then fade away. I, on the other hand have a much better ideal.

I live in Texas where your servers are located, I will file a small claims for my credits earned on your site and not paid out. Win or lose I will send copies of the judgement to every video producer on the Web whose videos and Photos are on your site.

What I find more interesting is the fact that 100% of the deleted accounts always have huge credits.

Seems to me like someone does not want to pay and keeps pointing to some fictitious notice that no one has ever seen yet.

Really? I had 12kk+ views, 1k+ subscribers and 12k+ credits earned for over the year of uploading videos and when I tryed to cash them out (october 30th) my account was deleted (~17th november) with no warning or explanation why. If I didn't deserved that second chanse that you were talking about, then I dont know who does. You could at least cashed my credits before kick me...

lets say that DMCA YMCA really sends you warnings of copyrights, do you send warnings to memebers notifying them that their account is in a risk of being deleted for not following your TOU? and lets say you answer "YES we do" then how many strikes a mamber has till their account is closed?

The TOU says it all, you break the rules stated in the TOU once you might get deleted, or maybe we'll give you another chance. You break it many times, your account will get deleted for sure.

Since you never tell us why our uploads are deleted how can we know it's DMCA? Yep you guys need your ass sued off. You are up and up using the members to line your pockets and then stealing their money when they get enough credits to cash out.

Stealing whose money? This is a filehost, not a lottery. As said ad nauseum in this thread, it's all in the TOU. Just like any website onto which material can be uploaded, the site reserves the right to delete content with or without prior notice to you. Just like with any website, you are bound to our Terms Of Use every time you use the site. I'm sorry but just because you don't understand the contents within it does NOT make you exempt from it.

You CAN however ask for help understanding a certain terms.

As an addendum, most of the content that gets uploaded onto this site has been taken from elsewhere. That's the nature of the internet, really. However when the legal owner of whatever material may exist on our servers demands the site take it down, it is taken down immediately. You mentioned being sued? Yeah, that happens. Because the DMCA is real, and deletions based on it are real.

1) We don't need to tell you if your uploads are DMCA'ed or not, that's your responsibility to know before you upload. thats how the Internet works.
2) we are stealing no one's money. The credits we give you are a award we decide to give you, it's not a paycheck that you deserve. we can discontinue it any time we want, if we really wanted to be assholes we would had done that by now instead. This award is given to users as long as they meet certain conditions, one of them is to follow the TOU.

Dozens of users have gotten paid and dozens more will get paid soon.

Stupid people not knowing how the internet works these days. This is very common with just about every site that hosts videos. All mods, admins and whoever else that is part of this site that responded to this is 100% correct. Don't blame them they have no control over, blame the laws that made this possible. The DMCA has been suing people since the days way before napster and it's a very real threat.

Next time people if your going to complain about laws and whats legal, dont just spout BS like you know what your talking about. It makes you look like a dumbass and uneducated.

I meant the DMCA has been used to sue people not the DMCA as its an organization. DMCA stands for Digital Media Copyright Act, so that made no sense. Just clarifying what I meant to say. So there is no confusion.
